Agreement to Our Legal Terms

We are Floxt ("Company", "we", "us", or "our"), a company registered in Australia at 176 Springs Rd, Spring Farm 2570. We operate the website https://www.floxt.com.au as well as any other related products and services that refer or link to these legal terms (collectively, the "Services").

Floxt is a queue and booking management platform built for Australian barber shops. It allows barber shop owners to manage walk-in queues, online bookings, staff rosters, and customer loyalty programs. Customers can join queues remotely, book appointments, and track their position in real time.

These Legal Terms constitute a legally binding agreement between you and Floxt. By accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE, YOU MUST DISCONTINUE USE IMMEDIATELY.

All users who are minors must have the permission of, and be directly supervised by, their parent or guardian to use the Services.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation.

2. Intellectual Property Rights

We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics. Our Content and Marks are protected by copyright and trademark laws around the world.

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services solely for your personal, non-commercial use or internal business purpose.

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity to comply with these Legal Terms; (4) you are not a minor, or if a minor, you have received parental permission; (5) you will not access the Services through automated or non-human means; (6) you will not use the Services for any illegal or unauthorised purpose; and (7) your use will not violate any applicable law or regulation.

4. User Registration

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password.

5. Purchases and Payment

We accept Visa, Mastercard, and American Express. All payments shall be in AUD. You agree to provide current, complete, and accurate purchase and account information for all purchases. We may change prices at any time.

6. Subscriptions

Billing and Renewal: Your subscription will continue and automatically renew unless cancelled. The billing cycle is monthly.

Free Trial: We offer a 14-day free trial to new users. The account will not be charged and the subscription will be suspended until upgraded to a paid version at the end of the free trial.

Cancellation: All purchases are non-refundable. You can cancel your subscription at any time by contacting us at support@floxt.com.au. Your cancellation will take effect at the end of the current paid term.

Fee Changes: We may from time to time make changes to the subscription fee and will communicate any price changes in accordance with applicable law.

7. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user, you agree not to:

  • Systematically retrieve data to create a database or directory without written permission
  • Trick, defraud, or mislead us and other users
  • Circumvent or disable security-related features of the Services
  • Use the Services for any illegal or unauthorised purpose
  • Upload or transmit viruses, Trojan horses, or other harmful material
  • Engage in any automated use of the system including data mining or scraping
  • Attempt to impersonate another user or person
  • Use the Services to compete with us or for any revenue-generating enterprise without our approval

8. Third-Party Websites and Content

The Services may contain links to other websites. Such third-party websites are not investigated, monitored, or checked for accuracy by us, and we are not responsible for any third-party websites accessed through the Services.

9. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy at floxt.com.au/privacy. By using the Services, you agree to be bound by our Privacy Policy. The Services are hosted in Australia.

10. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to deny access to and use of the Services to any person for any reason without notice or liability. If we terminate or suspend your account, you are prohibited from registering a new account.

11. Governing Law

These Legal Terms shall be governed by the laws of Australia. Floxt and yourself irrevocably consent that the courts of Australia shall have exclusive jurisdiction to resolve any dispute arising in connection with these Legal Terms.

12. Dispute Resolution

The parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration. Any unresolved dispute shall be referred to arbitration in Sydney, Australia, conducted in English with one arbitrator.

13. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. OUR LIABILITY TO YOU WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
